Successfully Obtained Summary Judgment on Behalf of Defended Petroleum Company in Lawsuit Alleging Price-Fixing of New Formulation Gasoline

Aguilar, et al. v. Atlantic Richfield, et al., S086738 (Cal. 2001)

Robins Kaplan represented a petroleum company in a state law antitrust class action alleging an unlawful conspiracy to restrict the output and raise the price of a new formulation of gasoline. The trial court initially granted defendants’ motion for summary judgment, but later granted plaintiff’s motion for a new trial. The Court of Appeal reversed the decision granting a new trial and the decision was subsequently affirmed by the Supreme Court of California.
