Fire and Explosion Litigation

Overview

It matters who represents you. Whether you are a plant owner, product manufacturer, property insurer, or injured worker, fire and explosion events can be catastrophic. When the stakes are high, you want an advocate who knows how to deliver results.

We know fires and explosions. Robins Kaplan has been at the forefront of fire and explosion litigation for more than 50 years. Our lawyers have represented individuals and corporate defendants across the country in personal injury, wrongful death, property damage, and subrogation cases. We have litigated fire and explosion events fueled by combustible dust, propane, natural gas, and chemical compounds, including many of the country’s most significant industrial disasters. We have represented clients involved in six fires or explosions investigated by the CSB – the Chemical Safety and Hazard Investigation Board.

We know combustible dust. Called an “insidious hazard” by the CSB, combustible dust can fuel devastating fires and explosions. Many simply do not know about the hazards of combustible dust and how to mitigate them. Robins Kaplan has represented clients in numerous combustible dust cases across the country. We bring a deep understanding of the science behind combustible dust events and the nuances of establishing or defending liability.

We know how to litigate fires and explosions. From day one, our lawyers are by your side, helping to secure the site and preserve evidence, interface with regulatory agencies, and investigate the cause and origin of the fire or explosion. We understand our client’s strategic and personal objectives and aggressively position cases to best achieve the desired outcome—whether that is settlement or trial to verdict.

We know how to win. Robins Kaplan has a proven ability to represent corporate clients and injured individuals in high-stakes fire and explosion cases. Our lawyers obtained a dismissal with prejudice for a corporate client following a natural gas explosion that killed more than 30 people and injured dozens more. We obtained summary judgment for a product manufacturer following a hazardous chemical release and explosion where the personal injury plaintiffs later settled for $18.5 million. Our lawyers also have a long history of securing recoveries for burn survivors. We represented a 32-year-old male with third-degree burns over 70 percent of the body resulting from an industrial accident, and settled with defendants for $15.4 million. Because we represent burn survivors and corporate defendants, our lawyers can build or attack a case from all angles. This dual practice gives us credibility and deep insight—both of which we use to drive results.

Fire and explosion events are often catastrophic, resulting in severe personal injuries and loss of life, property damage, permanent plant closures, product retrofits or recalls, and substantial insured and uninsured losses.

Robins Kaplan is committed to helping clients navigate the aftermath of fires and explosions, including:
