Alayna Albrecht-Payton v. Brooklyn Center Police Department, et al.

Robins Kaplan secured a $350,000 settlement for its client, Alayna Albrecht-Payton, the passenger of Daunte Wright, who was shot in his vehicle in Brooklyn Center, Minnesota. The lawsuit alleged that Brooklyn Center is liable for former Minnesota police officer, Kimberly Potter’s negligent conduct that led to our client’s injuries, both physical and beyond.

In 2021 Potter fatally shot Wright, claiming that she mistook her firearm for her taser. The point-blank shot resulted in a car crash that left our client with multiple injuries including facial lacerations, a broken jaw which surgery was required to repair, and severe emotional distress. In the moments following the crash, instead of receiving help for Alayna, officers placed her in handcuffs and held her at gunpoint. She was hospitalized for three days, and in the following months struggled with sleeping and eating due to her injuries. She has since been diagnosed with post-traumatic stress disorder, acute stress disorder, generalized anxiety disorder, and major depressive disorder.
