Civil Rights Attorneys Reached $6.2 Million Settlement in Wrongful Shooting Lawsuit

Olthoff, Shawn v. Warnygora et al.

Robins Kaplan civil rights attorneys obtained a $6.2 million settlement on behalf of client, Shawn Olthoff. In July 2019, Mr. Olthoff was the subject of a CERT Team call-out in Carlton County, Minnesota. His mother attempted to peacefully surrender him to authorities by providing information for entry and informing them that he was asleep in her trailer and unarmed. Mr. Olthoff was lying on his side when officers entered the trailer and put his hands in the air, following police commands. 

While our client’s hands were in the air, Carlton County Sgt. Warnygora proceeded to shoot Mr. Olthoff twice in the right armpit. It was later admitted that Sgt. Warygora was sitting at a bar when he responded to the CERT call and had consumed alcohol. Mr. Olthoff is currently paralyzed from the chest down and has already accrued over $640,000 in medical expenses with future medical needs required due to his paralysis.
