Overview

Nate is an experienced commercial litigator who represents companies and individuals in all manners of business disputes, with a particular emphasis on healthcare litigation and government investigations. Nate represents healthcare payors in high-dollar disputes across the country in both affirmative and defense matters, often involving fraud, breach of contract, ERISA, and other state and federal statutes. Nate has a long track record of working with healthcare-payor clients to recover overpayments and protect clients and their customers. In 2021, Nate was named an Attorney of the Year by Minnesota Lawyer magazine for being part of a team that secured a $25.6 million jury verdict for a healthcare payor client arising from a fraudulent billing scheme. 

In addition, Nate represents individuals and companies in response to governmental investigations. Nate has represented domestic and foreign clients as parties and third parties in investigations and proceedings conducted by the Department of Justice, the Securities and Exchange Commission, the Department of Health & Human Services, the Department of Labor, the Commodity Futures Trading Commission; state authorities, and other investigative bodies. Nate’s investigations experience includes, but is not limited to: healthcare fraud, including the Anti-Kickback Statute; securities fraud and insider trading; ERISA; tax; market manipulation; and the Foreign Corrupt Practices Act.

Prior to joining Robins Kaplan in 2016, Nate worked at an international law firm in New York, where he was a member of the White Collar Crime and Government Investigations and Business Litigation practices. After law school, Nate also completed a one-year fellowship with the San Francisco Public Defender’s Office.

Selected Results

Representative Matters

  • Represented Blue Cross and Blue Shield of Missouri and other Blue Cross Blue Shield plans in litigation against defendants who conspired to defraud the healthcare insurers through utilization of a laboratory pass-through billing scheme. The defendants and their co-conspirators took control of a Critical Access Hospital in Unionville, MO called Putnam County Memorial Hospital, and used the hospital to bill our clients $18 million for lab tests performed by their laboratory in Colorado. By billing the tests through the hospital, they obtained substantially inflated reimbursements. Robins Kaplan secured a jury verdict for compensatory and punitive damages totaling $25.6 million.
