Overview

David Martinez represents a wide range of U.S. and international clients in all forms of dispute resolution and business counseling, with emphasis in the areas of commercial, intellectual property, unfair competition, shareholder and partnership litigation, arbitration and mediation. His clients range from individuals to start-ups to Fortune 100 companies in the real estate, fashion, media, financial, entertainment, manufacturing, technology and legal services industries. He also serves as outside general counsel for select clients.

Mr. Martinez has substantial experience in partnership disputes, including representation of a prominent national law firm in a dispute with departing partners.  These clients especially appreciate David’s deep understanding of law firm operations based on his experience as a member of the Robins Kaplan Executive Board.

Mr. Martinez has won a reputation for his fierce commitment to his clients’ interests. Clients have commented on his ability to out-think and out-work his opponents, and they often call on him to go on the offensive with aggressive campaigns against their adversaries.  This commitment has led to outstanding results for clients in a broad range of matters, including recovering hundreds of millions in antitrust damages on behalf of a preeminent national retailer and securing dismissal of racketeering claims against civil RICO defendants.

Mr. Martinez is often recognized by his clients and peers for excellence in the legal industry, including as one of the 500 Leading Litigators in America by Lawdragon; a Leader of Influence by the LA Business Journal; a Top Intellectual Property Lawyer by the Los Angeles Daily Journal; and a Stand-Out Lawyer by Thomson Reuters.  He is routinely listed in the Best Lawyers in America, Super Lawyers, and World Trademark Review 1000 publications.

Mr. Martinez joined the U.S. Navy when he was seventeen years old.  After four years of honorable service in the U.S. and abroad, he turned to a career in law, graduating cum laude from Southwestern University School of Law, where he served on the Southwestern Law Review. Despite his heavy commercial litigation caseload, Mr. Martinez has made time to represent hundreds of pro bono clients over the last twenty-five years and serves on the Board of California Rural Legal Assistance, Inc., a public interest law firm championing the rights of farm workers and the rural poor.

David immigrated to the United States as a child and is fluent in Spanish.  During his personal time, he enjoys all things outdoors including hiking, swimming, and skydiving. He loves spending time with his family and coaches his son’s Pony Baseball All-Star teams.
