Overview
Brandon Carmack applies a litigation lens to every aspect of his practice. He has represented a range of commercial disputes involving both start-up companies and international complex corporations. Carmack now focuses his advocacy in specialized areas of intellectual property and technology litigation.
Prior to working as an IP litigator, Carmack earned his Bachelor of Arts in Political Economy at Hillsdale College. As part of his degree, Carmack spent two summers in Guatemala where he researched proposed legislation to reform the Guatemalan constitution and its potential effects on the Guatemalan economy. Upon graduation, Carmack moved from Michigan to Minnesota where he began working for a policy think-tank and eventually moved into banking technology. While working in banking, Carmack helped banks advocate for policy reforms in the bank technology space. His love for economics, technology, and the law drove him to law school, where he graduated magna cum laude.
Carmack enjoys helping companies solve complex business problems related to their intellectual property and commercial disputes. With respect to IP, Carmack protects his clients’ patents, trademarks, and copyrights from infringement. Clients often have a very narrow view as to what constitutes “infringement,” and feel they are powerless to protect themselves. Carmack navigates his clients’ concerns by explaining the true scope of infringement and the tools for protecting the DNA of their business.
With respect to commercial disputes, Carmack helps growing, mid-market companies stand up for themselves when vendors, employees, or competitors try to take advantage of their marked success. Unfortunately, commercial respect for contracts continues to wane, and mid-market companies tend to be targeted from larger companies who see their success as a threat, smaller competitors who get jealous, and disgruntled employees. Carmack believes every case has a unique resolution proposition, and accordingly, a unique path to that resolution.
Carmack’s practice philosophy is “active service.” Carmack tries to avoid “analysis paralysis” while also ensuring he is the most prepared lawyer in the room. This is an art, not a science.
Carmack lives in Chanhassen, Minnesota with his wife, Dr. Jessica Carmack. Together they raise their daughters, Madison and Eloise. When Carmack is not practicing law, he enjoys outdoor cooking, bonfires, and spending time with friends, particularly when the Michigan Wolverines are succeeding in football.
Brandon hopes his life-experience has made him a well-rounded person that brings a down-to-earth approach to legal practice.

Representative Matters
Crystal IS, Inc. v. Nitride Semiconductors Co. (N.D.N.Y. 1:12-CV-0606): Counsel for declaratory judgment plaintiff Crystal IS, a manufacturer of Ultraviolet LED semiconductors, in defense of patent infringement allegations. Crystal IS filed an early summary judgment motion of non-infringement, which the Court agreed to hear before claim construction. Following a thorough summary judgment Order, which dismissed one asserted claim and identified multiple potentially “dispositive” claim construction issues for the other asserted claim, the case settled on confidential terms.
Wapp Tech Limited Partnership v. Wells Fargo Bank, N.A. (E.D. Tex. No. 4:21-cv-00671): Represented plaintiff Wapp Tech in patent infringement litigation against Wells Fargo in the U.S. District Court for the Eastern District of Texas. Asserted infringement of five patents covering technologies relating to mobile application development and testing. Case resolved successfully on confidential terms prior to trial.
