Law360, New York -- In the first installment of this article, we examined the factors that have contributed to a claim construction "conundrum" wherein district courts must grapple with the competing goals of resolving claim construction disputes and efficiently managing litigation. In this second part, we elaborate on a potential solution, which calls for creating and enforcing predictable and fair rules for waiver of untimely claim construction disputes, subject to a showing of good cause.
