Normally, appellate courts decide the issues that are brought to them. They only rarely take the initiative to go outside of the trial court record and the briefs of the parties to come up with their own issues. But there is a notable exception when jurisdiction is involved. The 8th U.S. Circuit Court of Appeals recently made this point with a large exclamation mark.
