On Tuesday, March 19, Patrick Arenz presented at the USC Gould School of Law 2024 Intellectual Property Institute on a session titled, "Where is this Story Going?: Trends in Copyright Litigation in the Ninth Circuit." For years, Hollywood studios could count on a robust review of substantial similarity issues for copyright cases at the pleading stage in courts in the Ninth Circuit. Recently, there has been a perception that the Court is shifting away from early dismissals. This panel discussed what this means in practice, whether there is a difference in cases involving music versus literary works, and what may lie ahead for copyright litigation.
